Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs all NGO Partners' use of the Sawa Impact Platform and is incorporated by reference into the Agreement. Violations of this AUP are grounds for immediate Suspension or termination.
B.1 Eligible Organizations
The Platform is available exclusively to: (a) U.S.-based organizations with valid IRS 501(c)(3) determination letters; (b) non-U.S. charitable organizations with valid equivalent status under applicable foreign law; or (c) organizations with pending 501(c)(3) applications, subject to Sawa's discretionary approval and enhanced monitoring. Organizations without charitable status may not receive Donations through the Platform.
B.2 Permitted Campaigns and Projects
NGO Partners may create Projects for any bona fide charitable, educational, scientific, literary, or religious purpose consistent with their Tax-Exempt Status. Each Project must accurately describe the purpose, intended beneficiaries, and anticipated use of Donations. Projects must be updated promptly upon material changes.
B.3 Prohibited Campaigns and Uses
The following uses are strictly prohibited and will result in immediate Suspension without notice:
- Fundraising for individuals, for-profit businesses, political candidates, political parties, PACs, or ballot measures;
- Fundraising for activities that violate Applicable Law in any jurisdiction, including illegal weapons, controlled substances, or terrorist financing;
- Fundraising for programs that discriminate on the basis of race, ethnicity, national origin, gender, sexual orientation, or disability in a manner inconsistent with applicable civil rights law;
- Misrepresenting the use of Donations or providing false information about the NGO's activities, financials, or beneficiaries;
- Using the Platform as a pass-through to transfer funds to sanctioned individuals, entities, or regions;
- Soliciting Donations for emergency or disaster relief without appropriate regulatory authorizations;
- Creating duplicate campaigns or Projects with the intent to misappropriate Donations;
- Operating Projects that benefit private individuals in a manner constituting private benefit or private inurement; or
- Any use that, in Sawa's sole judgment, poses legal, regulatory, financial, or reputational risk to Sawa or the Platform.
B.4 Content Standards
All NGO Partner Content must: (a) be accurate, truthful, and not misleading; (b) not infringe any third-party IP right; (c) not contain defamatory, harassing, discriminatory, obscene, or illegal content; (d) not contain malware, phishing links, or harmful code; and (e) comply with all applicable advertising and consumer protection laws.
B.5 Enforcement
Sawa reserves the right to review, moderate, and remove any NGO Partner Content or Project at any time without notice. Sawa may Suspend or terminate any NGO Partner's account for AUP violations and may report violations to Payment Processors, law enforcement, or regulatory authorities. Sawa's enforcement decisions are final. Sawa has no obligation to monitor content but reserves all rights to do so.
