C.1 Platform Access and Eligibility
Users must be at least eighteen (18) years of age (or the age of legal majority in their jurisdiction) to make Donations or create accounts. By using the Platform, Users agree to these Terms, the Privacy Policy, and all applicable Platform Policies. Use of the Platform constitutes a binding legal agreement.
C.2 Donations: Voluntary and Non-Refundable
All Donations are voluntary and generally non-refundable, except as required by Applicable Law or as determined by Sawa in its sole discretion. Sawa does not guarantee the tax deductibility of any Donation. Donors are solely responsible for confirming the tax-exempt status of any NGO Partner before making a tax-deductible contribution. Sawa issues Donor Acknowledgments as a ministerial convenience on behalf of NGO Partners and is not responsible for their tax validity.
C.3 Payment Processing
All payments are processed by third-party Payment Processors (Stripe, PayPal, or their affiliates). By submitting a Donation, Users agree to the applicable Payment Processor's terms of service. Sawa does not store full credit or debit card numbers. Platform Transaction Fees and Payment Processor fees are disclosed at checkout.
C.4 Data Collection and Privacy
By using the Platform, Users consent to Sawa's collection, processing, and storage of personal data as described in the Privacy Policy, including: name, email address, payment information, donation history, IP address, and device data. Sawa uses this data to provide the Services, generate Donor Acknowledgments, prevent fraud, and improve the Platform. Sawa does not sell personal data to third parties. Users may request access, correction, or deletion of their personal data by contacting legal@sawatogether.com.
C.5 Cookies and Tracking
The Platform uses cookies, pixels, and similar tracking technologies as described in the Privacy Policy. Users may opt out of non-essential cookies through the Platform's cookie preference center, but doing so may limit certain functionality.
C.6 User Conduct
Users may not: (a) impersonate any person or entity; (b) submit fraudulent or unauthorized Donations; (c) use bots or automated scripts on the Platform; (d) attempt to access accounts, systems, or data to which they are not authorized; (e) post false, defamatory, or misleading content; or (f) violate any Applicable Law.
C.7 Disclaimer and Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAWA SHALL NOT BE LIABLE TO ANY USER FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DONATIONS, FAILED TRANSACTIONS, OR DATA LOSS. SAWA'S TOTAL LIABILITY TO ANY USER SHALL NOT EXCEED THE AMOUNT OF THE SPECIFIC DONATION AT ISSUE.
C.8 Dispute Resolution
User disputes with Sawa shall be resolved by binding individual arbitration under AAA Commercial Rules in Wilmington, Delaware. Class actions are waived. Governing law: State of Delaware.
